By accessing our website or purchasing our products, you agree to be bound by the following terms and conditions.1. We reserve the right to refuse service to anyone for any reason at any time.2. Product Safety & Assumption of RiskWARNING: Candles are fire hazards. Improper use can result in fire, injury, or death.

By purchasing our products, you acknowledge that:

• Burn Instructions: You must follow all safety instructions provided on product labels, including burning within sight and keeping away from flammable objects.
• Waiver of Liability: You voluntarily assume all risks associated with the use of our candles. Farmland Cottage Candle Company, LLC is not liable for any damages, injuries, or losses resulting from the use, misuse, or unattended burning of our products.

3. Limitation of LiabilityTo the maximum extent permitted by Ohio law, Farmland Cottage Candle Company, LLC, its members, and employees shall not be liable for any indirect, incidental, or consequential damages arising out of your use of our products or website. Our total liability to you for any claim shall not exceed the amount you paid for the product in question.

4. Shipping, Returns, & Refunds

• Accuracy: You are responsible for providing accurate shipping information.
• Risk of Loss: Once an order is handed to a carrier (e.g., USPS, UPS), the risk of loss and title for the items pass to you.
• Ohio Return Policy: In accordance with the Ohio Attorney General's guidelines, we clearly state that all sales are final unless a product arrives damaged. Damaged items must be reported within 10 days of delivery with photographic evidence.

5. Intellectual PropertyAll content on this site, including logos, designs, and text, is the property of Farmland Cottage Candle Company, LLC and is protected by copyright and trademark laws. You may not use our branding without express written permission. 

6. Governing LawThese Terms shall be governed by and construed in accordance with the laws of the State of Ohio. Any disputes arising from these terms shall be resolved exclusively in the state or federal courts located in Ohio. 

7. IndemnificationYou agree to indemnify and hold harmless Farmland Cottage Candle Company, LLC from any claims, damages, or expenses (including attorney fees) arising from your breach of these Terms or your misuse of our products.

8. PRODUCT LIABILITY WAIVER, ASSUMPTION OF RISK, AND LIMITATION OF LIABILITY

1. Assumption of Risk. By purchasing and utilizing products from Farmland Cottage Candle Company (hereinafter referred to as "the Company"), including but not limited to candles, wax melts, and accessories, you explicitly acknowledge that these products involve inherent risks. These risks include, but are not limited to, the risks of open flames, extreme heat, molten wax, fire, smoke inhalation, property damage, personal injury, and severe burns. You voluntarily assume all risks, both known and unknown, associated with the storage, handling, lighting, and general use of these products.

2. Strict Compliance with Safety Instructions. You agree to read and strictly adhere to all safety guidelines, warning labels, and usage instructions provided on the product packaging, product labels, and the Company website (including the Candle Safety and Wax Melt Safety Guides). The Company is not responsible, liable, or legally accountable for any injuries, damages, or losses resulting from failure to follow instructions, altering the product, using faulty third-party warming devices, or general negligence.

3. Limitation of Liability. To the maximum extent permitted by applicable law, in no event shall Farmland Cottage Candle Company, its members, managers, employees, or affiliates, be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages. This includes, but is not limited to, property damage, personal injury, medical expenses, loss of income, or wrongful death arising out of or in connection with the purchase, use, misuse, or inability to use any product sold by the Company.

4. Sole and Exclusive Remedy. In the event that the Company is found liable under any legal theory (whether in contract, tort, strict liability, or statutory breach), your sole and exclusive remedy, and the Company’s maximum aggregate liability, shall be strictly limited to a full refund of the actual purchase price paid by you for the specific product that allegedly caused the damage or injury.

5. Governing Law and Jurisdiction. These Terms and Conditions, and any disputes or claims arising from the purchase or use of the Company's products, shall be governed by, interpreted, and enforced in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. You explicitly agree that any legal action, lawsuit, or proceeding arising out of these products must be filed exclusively in the state or federal courts located in Wayne County, Ohio, and you consent to the personal jurisdiction of such courts.
